U.S. DV Lottery is not affiliated with the United States Department of State, the United States Department of Homeland Security, the United States Citizenship & Immigration Services (USCIS), or any other United States governmental agency.
§1 Scope of Application
1.1 The general terms and conditions between American Eagle - American Eagle OÜ (hereafter referred to as "we") and the customer become immediately effective at the time the respective contract for participation in the Green Card Lottery is concluded.
Individual orders for consultation and processing of any US-Visa outside of the Green Card Lottery are only valid when separately concluded and agreed upon. We will be pleased to send you these separately before the contract is finalized.
1.2 Terms and conditions of the customer that contradict or deviate from these general terms and conditions are not recognized unless we have explicitly agreed to their validity in writing. Our general terms and conditions also apply when we provide the service without reservation, even if we are aware of the customer's terms that are contrary to or deviate from our terms of business.
§2 TERMS FOR PARTICIPATING IN THE GREEN CARD LOTTERY
2.1 Conclusion of the Contract
2.1.1 Our service offer, as described in newspapers, on the internet, etc., does not constitute a legally binding offer. The customer enters into a legally binding contract by submitting the application to participate in the Green Card Lottery, either via post or digitally through the website www.us-dvlottery.com.
2.1.2 If you submit your application online, your order will be executed after you have filled in your personal data and clicked on the "apply now" button. During the ordering process, you can correct your data at any time by clicking on the "back" button. As long as you have not clicked on the "apply now" button after completing the application, you can exit the entire application process at any time.
2.1.3 When you submit your application at www.us-dvlottery.com, you will immediately receive an email from us confirming the submission of your application. This email serves to confirm that your order has been submitted to us and is not a binding acceptance of the order.
2.1.4 A contract is only considered concluded when the order is confirmed by us in written form or when the application form is processed. The order confirmation can be likened to the receipt of the order.
2.1.5 When applying online, we will save the contractual text.
2.2 Cancellation Policy
2.2.1 Right of Revocation
The customer can withdraw from the contract in written form (e.g., letter, email) within two weeks without providing a reason. The two-week period begins when the customer receives the cancellation policy in written form, but not before the conclusion of the contract. To cancel, please contact:

2.2.2 Revocation Consequences
If the contract is successfully withdrawn, the services received by both parties must be returned, along with any benefits derived from them (e.g., interest). If the customer cannot return the received service in its entirety or can only do so in a deteriorated condition, they must provide compensation for the value of the service. To receive reimbursement, all obligations must be fulfilled within 30 days. The 30-day period commences with the cancellation notice for customers and upon receipt of the cancellation notice for us.
2.2.3 Special Condition
The customer's right to cancel expires prematurely if we commence providing services explicitly agreed upon before the end of the cancellation period or if the customer initiates services themselves (e.g., downloading).

2.3 Scope of Service
2.3.1 We offer customers guaranteed participation in the official United States Green Card Lottery. If the customer wins, we provide consultation throughout the application process until they receive their Green Card. Please note that we are not responsible for granting immigration visas or Green Cards; the United States immigration authorities hold sole responsibility for issuing visas and making these decisions.
2.3.2 The customer's data, when shared with us, will be submitted to the U.S. authorities responsible for the Diversity Visa in a timely and appropriate manner, as stipulated. In cases where the customer does not provide their data in a digital format, we will convert their application into the relevant digital format and, if necessary, ensure that photos are uploaded in the correct format. Upon receiving confirmation of submission, access to the application, and the Green Card Lottery results from the relevant U.S. authorities, we will promptly contact the customer with this information.
2.3.3 The scope of our services depends on the service package selected at the time: Basic, Smart, or VIP. All service packages guarantee customers' participation in the official United States Green Card Lottery and provide further guidance in case of a successful application. If the customer does not win, we inform them annually free of charge via email and, if necessary, by mail regarding the subsequent program.
Additionally, the Smart and VIP service packages cover the costs of the required round-trip flight to the USA to activate the immigration visa in the event the customer wins. We will arrange the flight once the immigration visa has been successfully granted. We cover the cost of an economy class plane ticket up to a value of US$1,500.00. The flight can be booked on any preferred date and to any preferred destination in the USA, subject to airline availability.
2.3.4 We would like to emphasize that participation in the current Green Card Lottery is only possible if the customer submits all required documents and complete data before the specified deadline. If, due to a failure to meet these deadlines, the customer is unable to participate in the current lottery, they have the option to submit the missing data within two weeks after the submission deadline. In such cases, their application will be automatically entered into the next lottery without any additional charges. After this two-week grace period, the application will be considered void, and no reimbursement will be provided. In such instances, the customer must file a new application for the upcoming Diversity Program.
2.3.5 If it becomes impossible to submit the customer's application for participation in the lottery to the responsible United States authorities due to unforeseeable circumstances or external forces beyond our control, such as war, embargo, disruption of (electronic) communication lines, technological limitations, changes in relevant laws, or alterations in the application submission process for the Green Card Lottery in the current year, both parties have the right to terminate the contract. In case of contract termination, the customer is obligated to pay a processing fee of €35 to cover any incurred expenses. Both parties in the contract reserve the right to provide evidence of lower or higher expenses.
2.4 Obligations of the Customer
2.4.1 The customer is required to provide us with all necessary information and materials (e.g., photos) in the form and quality requested by us before the deadline to participate in the official Green Card Lottery. During the ordering process, customers will be informed of the current deadline for submitting all data to us.
2.4.2 The customer is required to provide us with accurate data and promptly inform us of any changes. The customer is not authorized to apply multiple times with different names or addresses. We will not verify the information provided by the customer for content-related accuracy.
2.4.3 The customer transfers to us all rights of use for submitted photos and assures us that these rights do not infringe upon the rights of third parties (e.g., copyright laws). If a third party asserts a claim of infringement due to the unauthorized use of a photo, the customer is required to indemnify us against such third-party claims. The customer's obligations under the indemnity clause require them to cover the full legal defense costs (e.g., court and lawyer expenses) for us.
2.4.4 We explicitly emphasize that customers who win and accept their win must submit additional forms to the United States authorities on time to apply for the Green Card. Winners must also have their interview with the United States authorities before September 30th of the year following the announcement of the win; otherwise, the winner's entitlement to a Green Card expires. The customer is also obligated to assist us by collecting and sending us all necessary forms and paperwork in an organized and timely manner for the application process.
2.4.5 If the customer violates these obligations, we reserve the right to withdraw from the contract and/or claim compensation for breach of contract.
2.5 Prices
2.5.1 The prices are final and represent gross payments. They include the statutory value-added tax and all incidental costs that accrue within the scope of our service provisions. The prices cover the costs of participating in the Green Card Lottery and the further consultation provided for winners. Additionally, the prices for the Smart and VIP packages include the costs of the flight to the USA required for customers who win.
2.5.2 Not included in the price are services that extend beyond our general consultation services for winners. For example, our voluntary and non-compulsory Premium Consultation Service for winners is not covered. Furthermore, costs incurred from third-party services associated with the application process for customers who win, such as translation fees for accompanying documents, fees required by the responsible United States authorities, fees for notarized documents, etc., are also not included.
2.5.3 Exclusive offers for each individual service package will be clearly displayed as such on our website, in newspapers, etc.
2.5.4 Applications to participate in the Green Card Lottery sent via post will be subject to an additional €5.00 fee.
2.6 Payment
2.6.1 The service fee is due in full without deduction as soon as the participation application is processed.
2.6.2 The customer can choose from a list of payment methods offered at the time of ordering.
2.6.3 The customer defaults on their payment when the service fee has not been received by us within ten days of processing the participation application. In this case, we reserve the right to claim compensation for contract default and/or to withdraw from the contract. During the default, the customer must pay an interest rate of 5% above the base rate, and the company must pay 8% above the base rate. Our right to claim higher compensation remains unaffected by this.
2.6.4 We reserve the right to withhold services until full payment is made.
2.6.5 The customer is entitled to compensation only if their counterclaims, which are not in dispute and are legally enforceable, are recognized by us. Additionally, the customer is allowed to exercise their right of retention if their counterclaim is based on the same contractual relationship.
2.6.6 If the customer requests payment to be made with a credit card and the order is or becomes invalid, the customer is required to wait two weeks after sending a request for reimbursement in written form to us before arranging a chargeback. If the customer fails to meet these requirements, they will be required to pay the costs incurred for the chargeback by the credit institution concerned.
2.7 Limitations of Liability
2.7.1 We assume unlimited liability for fraudulent concealment of defects, breaches in the quality guarantee, claims under the Product Liability Act, injuries to life, limb, or health, as well as damages caused by intentional or gross negligence.
2.7.2 For other damages, we are only liable for breaches of contractual obligations, and among these, only those that were typically foreseeable at the time the contract was concluded.
2.7.3 Further claims by the customer - regardless of the legal basis - are excluded. We are especially not liable for lost profits or other financial damages of the customer.
2.7.4 We are only liable for proprietary content on our website www.us-dvlottery.com. We are not responsible for, and have no influence on, the content hosted on websites to which we provide access via links on our own website. We do not adopt external content as our own. This claim applies to all links featured on our website and to all content on the websites to which the links lead. Should we become aware of any illegal content hosted on such an external site, we will immediately block access to this site.
2.7.5 In cases where our contractual liability is excluded or limited, this also applies equally to the liability of our legal representatives and agents.
2.7.6 The actions and omissions of the United States authorities are beyond our sphere of influence; therefore, we cannot be held liable for their actions. This includes, especially, the failure of the US authorities to schedule an appointment with the immigration authorities responsible for granting Green Cards, leading to the customer losing their claim to have a Green Card issued to them.
2.8 Data Protection
2.8.1 We are committed to protecting data and safeguarding the privacy of all individuals who use our services. Your personal data will be handled with confidentiality. We adhere to the principles of data economy and data minimization, which means that we only collect and store data that is strictly essential for processing your order and maintaining contact with you, provided you have given your consent. This is in accordance with the terms set by the Personal Data Act of Finland and GDPR regulations of the European Union.
2.8.2 The data received from the customer will primarily be used for processing the Green Card Lottery application. We do not share your data with third parties, except for the United States authorities responsible for the Green Card Lottery Program. Data is shared with them only to the extent necessary for participating in the lottery. It should be noted that the responsible United States authorities are not subject to the strict data protection policies of the European Union.
2.8.3 To the extent that it is legally permissible, we are also entitled to collect, process, and share your data with a third party for our own marketing purposes. The customer has the right to object to or withdraw their consent for the collection, use, and transfer of their data at any time by notifying us. After receiving the objection or withdrawal of consent, we will not use, process, or transfer the data concerned for marketing purposes.
2.8.4 The customer is entitled to obtain information about their stored personal data, correct it, suspend it, or delete it at any time, free of charge. 2.10 Final Clauses
2.10.1 The laws of the Republic of Finland shall apply to all matters between us and the customer.
2.10.2 The exclusive place of jurisdiction for all disputes concerning this contractual relationship is Helsinki, Finland, without regard to conflict of laws principles that would require the application of the laws of another jurisdiction. The forum for dispute resolution shall be the public courts in Helsinki, Finland.
2.10.3 The contract language is English.
2.10.4 If individual terms of the contract become fully or partially void, the remaining terms of the contract will remain effective. If the contract becomes fully or partially void, both parties in the contract agree to substitute the voided term with one that is legally effective and economically and textually similar. The same applies if there are omissions in the contract.
